BitByteBots Terms of Service

BitByteBots is intended for use by parents and legal guardians.

Children may enjoy stories or products created through BitByteBots, but children may not create accounts, submit information, upload photos, communicate with AI, or use the website directly.

By using BitByteBots, you represent that:

• you are at least 18 years old
• you are the parent or legal guardian of any child for whom you create a profile or upload information
• you have authority to provide information about that child
• all information you provide is accurate to the best of your knowledge
• you will review AI-generated stories before sharing them with a child

BitByteBots is a parent-managed service.

You are responsible for:

• creating and managing your account
• choosing what child information to provide
• reviewing all stories before reading or sharing them with a child
• deciding whether a story is appropriate for your child
• updating or deleting child profile information as needed
• supervising how stories and products are used in your household
• keeping your login information secure

Stories are sent to the parent or guardian account, not directly to children.

BitByteBots collects limited child information only as directed by the parent or legal guardian. Our collection and use of child information is described in our Privacy Policy and Direct Notice to Parents.

By creating a child profile, activating personalized story delivery, uploading a child photo, or ordering a personalized product, you provide consent for BitByteBots to collect, use, and share the information as described in the Privacy Policy and Direct Notice to Parents.

If you revoke consent or request deletion of child information, we may no longer be able to provide personalized stories or products for that child profile.

Parents may contact us at hello@bitbytebots.com to request access, correction, deletion, export, or consent revocation.

Please do not provide sensitive child information unless specifically required for a product or support request.

Do not submit:

• full legal names
• home addresses, except where needed for shipping
• school names
• teacher names
• exact birthdates
• child email addresses
• child phone numbers
• precise location
• health information
• diagnoses
• government IDs
• passwords
• private family details
• anything you would not want included in a personalized story

For story personalization, a first name, nickname, or fictional story name is usually enough.

BitByteBots uses commercial AI services to help generate personalized stories.

You understand and agree that:

• stories are generated by AI
• stories are intended for parent review first
• stories may not be individually reviewed by a human before delivery
• AI-generated content may contain mistakes, unexpected wording, repetition, omissions, or content that does not match your preferences
• you are responsible for reading the full story before sharing it with a child
• you may delete, regenerate, report, or adjust story preferences where those features are available

We use story rules, safety checks, filters, and quality controls designed to reduce inappropriate or low-quality outputs, but we cannot guarantee that every story will be perfect or suitable for every child.

BitByteBots stories and content are for entertainment, creativity, and family use only. The Service does not provide medical, legal, psychological, educational, therapeutic, parenting, safety, or professional advice.

Do not rely on BitByteBots stories as a substitute for professional judgment, medical care, mental health support, legal advice, educational services, or emergency assistance.

You may need to create an account to use certain features.

You agree to:

• provide accurate account information
• keep your login credentials secure
• notify us if you suspect unauthorized account access
• use the Service only for lawful purposes
• not allow children to access or manage your account

You are responsible for activity under your account.

We may suspend or terminate accounts that violate these Terms, create risk, misuse the Service, fail to pay required fees, or interfere with the operation of BitByteBots.

Some BitByteBots services are offered as paid subscriptions.

By starting a subscription, you authorize us and our payment processor to charge your selected payment method for recurring fees, applicable taxes, add-ons, and other charges according to the plan you choose.

Subscription details may include:

• base monthly subscription fee
• additional child profile fees
• story delivery features
• optional add-ons
• renewal date
• billing frequency
• cancellation terms

Your subscription will automatically renew unless you cancel before the next billing date.

If your plan includes one child profile and charges for additional active child profiles, you agree that additional child profile fees may be added to your subscription based on the number of active child profiles in your account.

Inactive, paused, or deleted profiles may be handled according to the plan rules shown at checkout or in your account settings.

You may cancel your subscription through your account settings or by contacting support at hello@bitbytebots.com.

Cancellation stops future renewals. Unless otherwise stated at checkout or required by law, cancellation does not automatically refund charges already paid.

If you cancel, you may continue to have access until the end of the current billing period, unless your account is terminated for violation of these Terms.

Digital subscription fees are generally non-refundable unless required by law or specifically stated in a written refund policy.

For physical products, refund eligibility depends on the product type, production status, customization, and whether the item arrived damaged, defective, or materially different from the approved design.

Personalized products may not be refundable once production has started, except where required by law or where we determine there was a production error.

BitByteBots may offer printed books, posters, or other personalized products.

You are responsible for reviewing and approving personalization details before production, including:

• child name or nickname
• story text
• uploaded photo, if applicable
• design selections
• shipping information
• final proof, if provided

Once a personalized product enters production, changes may not be possible.

You represent that you have the right to upload and use any photo, name, text, or other content you submit for a product.

You may not upload images or content that violate another person's rights, include unlawful material, or exploit, harm, embarrass, or endanger a child.

If you upload a child photo, you represent that:

• you are the parent or legal guardian of the child shown, or you have legal authority to use the image
• you authorize BitByteBots to use the image to create and fulfill the product you requested
• the image does not violate anyone else's rights
• the image is appropriate for the requested product

We do not use child photos for AI training, targeted advertising, public marketing, social media, portfolio examples, or unrelated purposes unless you give separate written permission.

"User Content" means information, text, photos, names, preferences, feedback, and other materials you submit to BitByteBots.

You keep ownership of your User Content.

You grant BitByteBots a limited license to use, process, reproduce, modify, format, display, transmit, and share User Content as needed to:

• operate the Service
• generate stories
• create products
• fulfill orders
• provide customer support
• maintain safety and security
• troubleshoot issues
• comply with law
• enforce these Terms

This license ends when the content is deleted, except where continued retention is needed for legal, security, backup, compliance, billing, dispute, or legitimate operational reasons.

BitByteBots owns or licenses the website, software, branding, designs, templates, characters, illustrations, prompts, story formats, product layouts, and other materials provided through the Service.

You may not copy, modify, distribute, sell, reverse engineer, scrape, or create competing services using BitByteBots materials except as allowed by these Terms or with our written permission.

Subject to your compliance with these Terms and payment of applicable fees, you may use the stories generated for your account for personal, non-commercial family use.

You may read them to your child, print them for personal household use, and save them for your family.

You may not sell, publish, distribute, commercialize, or use generated stories to create competing products or services without our written permission.

If you submit feedback, ideas, suggestions, bug reports, or feature requests, you allow us to use them without restriction or compensation.

We will not intentionally use child personal information contained in feedback for public marketing or AI model training.

Please avoid including sensitive child information in feedback unless necessary for support.

You agree not to:

• use the Service for unlawful, harmful, abusive, or deceptive purposes
• allow children to create accounts or submit information directly
• submit sensitive child information that is unnecessary for the Service
• upload content that exploits, harms, sexualizes, embarrasses, bullies, or endangers a child
• upload content you do not have the right to use
• use the Service to generate sexual, violent, hateful, abusive, self-harm, exploitative, or unsafe content
• attempt to bypass safety filters
• interfere with the Service
• scrape, crawl, reverse engineer, or misuse the Service
• use automated systems to overload the Service
• access another person's account
• use BitByteBots outputs for model training, dataset creation, or competing AI services
• violate any applicable law

We may remove content, refuse generation, cancel orders, suspend accounts, or terminate access if we believe these rules are violated.

If you receive a story that seems inappropriate, too mature, too scary, unsafe, inaccurate, or otherwise concerning, please report it through the available product tools or contact hello@bitbytebots.com.

We may review reported stories, related prompts, safety results, and technical information to understand and address the issue.

We try to keep BitByteBots available and working well, but we do not guarantee uninterrupted, error-free, or always-available service.

Stories may be delayed, skipped, or fail due to technical issues, AI provider outages, email delivery problems, payment issues, account settings, safety checks, or other factors.

We may modify, suspend, or discontinue features at any time.

BitByteBots uses third-party providers for services such as hosting, payments, email delivery, AI generation, printing, fulfillment, shipping, analytics, security, and customer support.

Your use of BitByteBots may involve these providers. We are not responsible for third-party services outside our control, but we take steps to work with providers appropriate for the Service.

Your use of BitByteBots is also governed by our Privacy Policy and, where applicable, our Direct Notice to Parents.

If there is a conflict between these Terms and the Privacy Policy regarding how we collect, use, or protect personal information, the Privacy Policy controls for privacy matters.

We may offer promotions, discounts, coupons, free trials, or beta access.

Promotional offers may have additional terms, eligibility limits, expiration dates, and restrictions.

We may modify or end promotions at any time unless prohibited by law.

Some features may be released as beta, preview, experimental, or early-access features.

Beta features may be incomplete, unstable, changed, or discontinued at any time.

Use beta features at your own discretion.

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, BitByteBots disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and error-free operation.

We do not guarantee that:

• every story will be suitable for every child
• every story will be free from mistakes
• every AI output will match your preferences
• the Service will be uninterrupted
• emails will always be delivered
• physical products will be free from minor color, trim, or production variations
• the Service will meet every expectation

To the fullest extent permitted by law, BitByteBots and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, emotional distress, or business interruption.

To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to BitByteBots in the three months before the claim arose, or $100, whichever is greater.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

You agree to defend, indemnify, and hold harmless BitByteBots and its owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

• your use of the Service
• your User Content
• your violation of these Terms
• your violation of another person's rights
• your unauthorized upload or use of photos, names, or personal information
• your misuse of generated stories or products
• your violation of applicable law

You may stop using BitByteBots at any time.

We may suspend or terminate your account or access to the Service if:

• you violate these Terms
• payment fails
• your use creates legal, security, privacy, operational, or reputational risk
• we are required to do so by law
• you misuse the Service
• we discontinue the Service

After termination, some sections of these Terms will continue to apply, including ownership, privacy-related obligations, disclaimers, limitations of liability, indemnification, and dispute terms.

We may update these Terms from time to time.

If changes are material, we will provide notice by email, account notice, website notice, or another reasonable method.

Your continued use of BitByteBots after updated Terms take effect means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel any subscription.

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

Before filing a claim, you agree to contact us at hello@bitbytebots.com so we can try to resolve the issue informally.

If we cannot resolve the issue informally, you agree that all disputes will be handled through mediation in San Diego County, California.
